Shipper to Appeal After Judge Dismisses Claim Bunker Supplier "Abused its Dominant Position" in the Market
Finnlines Plc (Finnlines) says it will appeal the dismissal of a case it brought against OMB Ostsee Mineralöl-Bunker GmbH ('OMB') in Rostock, Germany, in which it claimed to have been overcharged by the bunker supplier.
"The Company's basis for the demand is that OMB has abused its dominant position in the relevant market and the Company was forced to buy fuel from OMB, OMB being the sole supplier," Finnlines explained in its latest 3Q 2016 financials.
The Helsinki-headquartered company says it has decided to take the case to the Court of Appeal after the District Court of Rostock dismissed its claims in full.
Finnlines is seeking €2.76 million ($2.99 million) in compensation from Bomin Group subsidiary OMB, an amount it says is "the price difference between the paid amount for the supplied fuel and the market price."
As Ship & Bunker reported yesterday, Finnlines said low bunker prices and lower consumption helped the company's record-breaking financial result during the January to September 2016 period.
