Singapore-Based Shipping Company Receives Additional Year of Probation Related to U.S. Pollution Offence

The U.S. Department of Justice (DOJ) Attorney's Office in the District of Connecticut says Singapore-based Odfjell Asia II PTE Ltd. (OAII) has been given an extra year of probation after the company admitted it failed to comply with the conditions of its three-year probation related to a 2014 conviction for violating the Act to Prevent Pollution from Ships.

OAII's probation required the company to implement remedial environmental measures under an Environmental Management System Plan (EMS/P), including the implementation of enhanced procedures for internal reporting of violations.

On May 16, 2016, a crewmember on OAII's vessel Bow Santos reported to the company that, while he was serving onboard, there may have been a MARPOL compliance issue involving the disposal of machinery-space bilge water in December 2015.

Following an internal investigation, OAII was unable to determine whether a MARPOL violation occurred.

"The U.S. and OAII agree that there was a breakdown in OAII's internal reporting system in that it took more than six months before any crewmember of the Bow Santos reported the alleged incident to OAII," explains the U.S. DOJ.

"OAII also agrees that the breakdown in OAII's internal reporting system constitutes a probation violation because the EMS/P's internal reporting system had not been fully implemented as required by the special conditions ordered by the court."

Under OAII's additional year of probation, Bow Santos will undergo an environmental audit, and OAII must notify the U.S. Probation Office, the U.S. DOJ, and the U.S. Coast Guard (USCG) if Oswaldo Dela Torre Salazar is serving onboard an OAII vessel bound for a U.S. port.
